Lagos Lawyer Sues FG, Others Over Military Incursion Of N’Delta, S/East

LAGOS NOVEMBER 19TH (NEWSRANGERS)-A Lagos lawyer Barr. Malcolm Omirhobo and his Foundation, Malcolm Omirhobo Foundation has dragged the Federal Government to Federal High Court, Abuja over military incursions of the Niger Delta and South Eastern Regions of Nigeria.
Sued along with the Federal government are President Muhammadu Buhari, Federal Attorney General, Service Chiefs, Nigeria Police, government of affected states, Inspector-General of Police and National Assembly among others.
In an application with suit number FHA/ABJ/CS/1378/2018 made available to NewsRangers, Omirhobo is asking the court to declare as illegal and unconstitutional the incursion of the aforementioned Regions of the Nigeria Military “Operation Crocodile Smile III and Operation Python Dance III by the Respondent to perform the constitutional functions of the Nigerian Police Force in the South East Zone and Niger Delta Region of Nigeria that is in peace.
He also ask the court to declare that the incursion of Military “Operation Crocodile Smile III and Operation Python Dance III is a violation of his Fundamental and Human rights and those of the Nigerian Public in the South-East Zone and the Niger Delta Region of Nigeria.
Omirhobo argued that in the course of the aforementioned military incursion many of South East and Niger Delta Regions citizens have been recklessly or brutally killed by the Nigerian Military who opened fire on unarmed civilians and some case kill innocent people tagging them as criminals when they engaged on various exercises of enforcing and maintaining law and order at the instance of the Respondents who have sidelined the Nigerian Police Force from performing her statutory responsibilities.
“My Lord, in view of the above, we urge your Lordship to hold that the killings of Nigerian citizens by the Nigerian Army, Air force and Navy without the backings of law is a violation of these persons rights to life and consequently unlawful, illegal and unconstitutional,” the applicants stated.
Omirhobo who affirmed that the Nigeria Police have shown their strength and true character both within and outside Nigeria in peace keeping missions pointed out that the current deployment of the Nigeria Military to the South East and Niger Delta Region is helping to kill the Nigerian Police as an institute in Nigeria Democracy making her weak and portraying them as not being able to carry out their routine functions without help from the Nigeria Military.
