Customs Officer In Trouble For Shunning Sharia Court Summons

JUDICIARY 3

LAGOS JANUARY 5TH (NEWSRANGERS)-The Kano State Upper Shari’ah Court, on Thursday, issued an order for the arrest of a Customs officer, Yusuf Ismail, alias Mai Biscuit, following his failure to attend court proceedings, concerning a property ownership case filed against him.

The presiding judge, Garba Malafa, gave the order pursuant to the prayer by counsel for the complainant, Idris Bello.

The complainant, Abdullahi Aliyu, is, in his suit, seeking the court’s intervention to stop the Customs officer from making good his threat to eject him from his property, No. 1,136 C, Kawaji Layout, Nassarawa Local Government Area of Kano State.

He told the court that Mai Biscuit marked his house with red paint and gave him an ultimatum to vacate the place.

Aliyu told the court that he obtained the property legally from the original owner.

When the case came up on Thursday for mention, the complainant’s counsel, Bello, told the court that the defendant was absent from court and did not send a representative, despite that the court bailiff had on January 4 served him with a court summons.

The lawyer said his prayer was backed by Section 352 of the Administration of Criminal Justice Law 2019.

“We are all aware that everyone is governed by the rule of law, now it is 10 am and the defendant was duly informed in the summons paper that the court will commence sitting by 9 am. His failure to attend the court today without any reason is contempt of court, which is criminal in nature,” Bello said.

After the bailiff confirmed to the judge that a court summons was indeed served on Mai Buscuit by showing proof of service, the judge ordered the Police to arrest the defendant and bring him to court.

“The defendant was not in court and was not represented without explanation. The bailiff affirmed to the court that he served the summons on the defendant. This case is a direct complaint from the complainant’s counsel. It is therefore crucial for the defendant to attend the court,” the judge held.

He adjourned till January 8 for mention.
